The ShareYaSpace Platform offers an online venue that enables users (Members) to list, offer, search for, and book shareable spaces.

Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests.”

Our mission is to democratize space renting for all anywhere in the world, and hence create a world where you are not bound by space large or small in order to attend to your personal or corporate needs.

In simple terms, ShareYaSpace exists to connecting people looking for spaces in the short to medium term to people who provide them.

User: Guests as well as Hosts - who create an account on the Platform over the age of 18 and with full legal capacity.

Guest: Any User requesting the booking of a Space from a Host through the mobile or web Platform, or a User who stays at a rentable Space.

Host: Any User who creates a Listing of a Space on the Platform or accommodates a Guest in his or her stay at the Space.

Services: Any service provided by ShareYaSpace.

Fee: Rental fee set by the Host in a Listing.

ShareYaSpace provides an online platform or marketplace that connects Hosts who have rentable Spaces to advertise with Guests seeking to use and/or rent such Spaces. The Services can be used to facilitate the Listing and booking of such Spaces.

It is possible to view Spaces as an unregistered visitor to the Platform. If you want to book a Space or create a Space, however, you first have to register to create a ShareYaSpace Account and become a User.

Note: The Users have the sole responsibility when interacting with other Users. ShareYaSpace has the right but has no obligation, to monitor interactions between Users.

These Terms of Service are a binding legal agreement between you and ShareYaSpace that govern your use of the ShareYaSpace mobile or web Platform.

To access and use many features of the ShareYaSpace Platform, you must register an account.

ShareYaSpace does not own, control, offer or manage any Listings or Host Services, and does acting as an agent in any capacity for any Member, except as specified in the Payment Terms.

As a Host, you are responsible for understanding and complying with all laws, rules, regulations, and contracts with third parties that apply to your Host Services.

We are a community built on trust. A fundamental part of earning that trust means being clear about how we use your information and protect your human right to privacy.

• 1. COLLECTING AND MANAGING PERSONAL INFORMATION

  We collect personal information about you when you use the ShareYaSpace Platform. Without it, we may not be able to provide you with all services requested. This information includes:

  • Contact Information, Account, Profile Information. Such as your first name, last name, phone number, email address, date of birth, and profile photo.
  • Identity Verification and Payment Information. Such as images of your government-issued ID, and bank account or payment account information.

  Note: All personal data given to ShareYaSpace are collected legally and fairly. This data provided by the Users, who agree by creating an account on the Platform, that they are voluntarily and expressly authorizing ShareYaSpace to process the data according to this Terms and Conditions.

  If you link, connect, or log in to the ShareYaSpace Platform with a third party service (e.g. Google, Facebook), you direct the service to send us information such as your registration, friends list, and profile information as controlled by that service or as authorized by you via your privacy settings at that service.

  We use the personal information you provide to Improve and Develop the ShareYaSpace Platform to:

  • Enable you to access the ShareYaSpace Platform and make and receive payments.
  • Enable you to communicate with other Members/Users.
  • Perform analytics, debug and conduct research.
  • Provide customer service.
  • Personalize and customize your experience based on your interactions with the ShareYaSpace Platform, your search and booking history, your profile information and preferences, and other content you submit.
  • Detect and prevent fraud, and other harmful activity.
  • Verify or authenticate information provided by you.
  • Comply with our legal obligations, protect the health and well-being of our Guests, Hosts, Hosts’ employees, and members of the public.
  • Enforce our agreements with third parties.
  • Comply with the law, respond to legal requests, prevent harm and protect our rights.
  • Enable or authorize third parties to use Payment Services, detect and prevent money laundering, fraud, abuse, security incidents, and provide and improve the Payment Services.

• 2. SHARING & DISCLOSURE

  2.1 Sharing Between Members.

  To help facilitate bookings or other interactions between Members, we may need to share certain information such as:

  • When a booking request is made, certain information may be shared between Guest(s) and Host(s), including profile, name, names of any additional Guests, cancellation history, review information, etc.

  When you as a Host have a confirmed booking, certain information is shared with the Guest (and the additional Guests they invite, if applicable) to coordinate the booking, such as your profile, full name, phone number, and Listing address.

  You can make certain information publicly visible to others, such as:

  • Your public profile page, which includes your profile photo, first name, description, and city.
  • Listing pages that include information such as the Space or precise location description, calendar availability, profile photo, aggregated demand information (like page views over a period of time), and additional information you choose to share.
  • Reviews, ratings, and other public feedback.
  • Content in a community or discussion forum, blog, or social media post.

• 3. MANAGING YOUR INFORMATION

  You can access and update some of your personal information through your Account settings. You are responsible for keeping your personal information up to date.

• 4. MANAGING YOUR INFORMATION

  We are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration using Blockchain Technology.

• 5. CHANGES TO THIS PRIVACY POLICY

  We reserve the right to modify this Privacy Policy at any time under applicable laws. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top.

  NB: We’re always learning and growing and the standards and expectations will evolve over time.

• 1. Searching and Booking on ShareYaSpace.

  • 1.1 Searching. You can search for rentable spaces by using criteria like the type of space, size, amenities, and number of Guests. You can also use filters to refine your search results.

  • 1.2 Booking. When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, applicable fees like ShareYaSpace service fee (and VAT).

  • If a Guest places a request for rental of a Space, the Host is required to accept or decline the said request. The Guest is committed to their reservation as soon as it is accepted by the Host and the Transaction/Rental Fee is paid in full. In case the Host had declined the reservation, the reservation is to be considered as cancelled and the payment is fully cancelled.

  • Note: A Host can cancel a booking after contacting ShareYaSpace directly. From there on ShareYaSpace will follow up on the Host’s request, to discuss possible solutions.

• 2. Cancellations and Refunds.

  In general, if as a Guest you cancel a reservation, because of an unexpected (and extenuating) circumstance that’s out of your control such as illness, political unrest, natural disaster, travel or movement restrictions imposed by a government, to or from the listing location, etc. However, you may have to provide official proof, where applicable.

  If you terminate your account as a Guest, any confirmed booking(s) will be automatically cancelled. If your reservation falls under a recognized extenuating circumstance, you’ll get a full refund if you are a Guest.

• 3. Your Responsibilities and Assumption of Risk.
  • 3.1 Your Responsibilities.

    You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you provide access to any Space. For example, this means: (i) you are responsible for leaving a Space (and related personal property) in the condition it was in when you arrived, and (ii) you must act with integrity, treat others with respect, and comply with applicable laws at all times.

  • 3.2 Your Assumption of Risk.

    You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the ShareYaSpace Platform, including your stay at any Space or any other interaction you have with other Members whether in person or online.

These Payments Terms of Service are a binding legal agreement between you and ShareYaSpace. ShareYaSpace Payments provides payment services to Members publishing, offering, and booking Spaces via the ShareYaSpace Platform. These payment services may include (if available) the following (collectively, “Payment Services”):

• Collecting payments from Guests, by charging fees associated with the service through their credit card, debit card;
• Effecting payments to Hosts (“Payout”) to a financial instrument associated with their ShareYaSpace accounts, such as their bank account.

To use the Payment Services, you must be at least 18 years old, must have a ShareYaSpace account, and must keep your payment and personal information accurate and complete.

Note:

All payments should always be made through ShareYaSpace. Don’t ever exchange money outside of the ShareYaSpace platform.

ShareYaSpace has no access to confidential bank data but uses the secure payment service provided by Paystack and Flutterwave.

• 1. Reviews.

  After each Host Service, Guests and Hosts will have an opportunity to review each other. Your Review must be accurate and may not contain any discriminatory, offensive, defamatory, or other languages that violate what we stand for. Reviews are not verified by ShareYaSpace for accuracy and may be incorrect or misleading.

  All the reviews on ShareYaSpace are written by Hosts and Guests who have completed their stay using ShareYaSpace. In addition to a written review, Guests are also asked to provide star ratings of their Hosts.

• 2. Content.

  Parts of the ShareYaSpace Platform enable you to provide feedback, text, photos, video, information, and other content. By providing Content, in whatever form and through whatever means, you grant ShareYaSpace a non-exclusive and transferable license to copy, modify, prepare derivative works of, distribute, publish and otherwise exploit, that Content.

  You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant ShareYaSpace the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party.

  ShareYaSpace cannot and does not control the Content contained regarding any Listing and the condition, legality, or suitability of any Space. All the disclosed content concerning and regarding Spaces through the Platform is based on the information and content provided by the Hosts.

  ShareYaSpace does not control the accuracy of the content generated by the Users. Therefore,

  ShareYaSpace does not guarantee the accuracy of the information provided in the content and would in no way be held liable for this information.

  Only the User, with the exception of ShareYaSpace, is responsible for all data and information concerning what they have provided, that the given information is not accessible by the public and more generally.

  Note: Each Host remains solely responsible at all times for the accuracy, completeness, and correctness of the (descriptive) information (including the rates and availability) displayed through the Platform.

• 3. Fees.

  ShareYaSpace charges fees (and VAT) to Hosts and Guests for use of the ShareYaSpace Platform, and service fees are non-refundable, unless of extenuating) cases or situations.

  Note: The price of the Fee is set by the Host for each Space and is to be paid in full by the Guest.

• 4. ShareYaSpace Platform Rules.
  • 4.1 Rules. You must follow these rules and must not help or induce others to break or circumvent these rules.
    • Act with integrity and treat others with respect
      • Do not lie, misrepresent something or someone, or pretend to be someone else.
      • Be polite and respectful when you communicate or interact with others.
      • Do not discriminate against or harass others.
    • Do not scrape, hack, reverse engineer, compromise or impair the ShareYaSpace Platform
      • Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the ShareYaSpace Platform or Content.
      • Do not take any action that could damage or adversely affect the performance or proper functioning of the ShareYaSpace Platform.
      • Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.
      • Do not engage in any practices that are intended to manipulate our search algorithm.
    • Honor your legal obligations
      • Understand and follow the laws that apply to you, including privacy, and data protection.
      • Do not use the name, logo, branding, or trademarks of ShareYaSpace or others without permission.
  • 4.2 Reporting Violations. If you believe that a Member, Listing or Content poses an imminent risk of harm to a person or property, or if you believe that a Member, Listing or Content has violated our standard, or infringes copyrights you should report your concerns to ShareYaSpace.
• 5. Termination, Suspension, and Other Measures.

  • 5.1 Termination. You may terminate this agreement at any time by sending us an email or by deleting your account. ShareYaSpace may terminate this agreement and your account for any reason by giving you 30 days’ notice via email or using any other contact information you have provided for your account.

    ShareYaSpace may also terminate this agreement immediately and without notice and stop providing access to the ShareYaSpace Platform if you breach these Terms, you violate our Policies, you violate applicable laws, or we reasonably believe termination is necessary to protect ShareYaSpace, its Members, or third parties.

    Guests can terminate any existing contract by meeting the requirement of the Cancellation Policy. Hosts can only terminate this Contract if he has met all his obligations resulting from the contract. A Host cannot, therefore, terminate this contract before all existing reservations are handled.

    ShareYaSpace reserves the right to restrict, suspend or terminate, without notice or refund, the account of any User who uses the Services improperly or inappropriately.

  • 5.2 Member Violations. ShareYaSpace believes it is reasonably necessary to protect ShareYaSpace, and its Members. ShareYaSpace may, with or without prior notice:

    • Suspend or limit your access to or use of the ShareYaSpace Platform and/or your account;
    • Suspend or remove Listings, Reviews, or other Content;
    • Cancel pending or confirmed bookings.

    For minor violations or where otherwise appropriate as ShareYaSpace determines in its sole discretion.

    Note: ShareYaSpace reserves the right to suspend accounts if we notice any activity that we believe is abusive, fraudulent, or in violation of the ShareYaSpace Terms of Service or Payments Terms of Service. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals at our sole discretion as deemed fair and appropriate.

  • 5.3 Content Policy

    In the event of repeated or severe violations, we may suspend or permanently deactivate the account(s) in question.

    • Content created solely for the purpose of advertising or other commercial content, including company logos, links, or company names.
    • Spam, unwanted contact, or content that is shared repeatedly in a disruptive manner.
    • Content that endorses or promotes illegal or harmful activity, or that is sexually explicit, violent, graphic, threatening, or harassing.
    • Content that is discriminatory.
    • Attempts to impersonate another person, account, or entity, including a representative of ShareYaSpace.
    • Content that is illegal or that violates another person’s or entity’s rights, including intellectual property rights and privacy rights.
    • Content that includes another person’s private or confidential information, including content that is sufficient to identify a listing’s location.

    The following are policy violations specific to a type of content:

    Listing titles

    • Listing titles that include information irrelevant to the listing type, style, or experience.

    Listing or profile pages

    • Listings and profiles that provide fraudulent, false, misleading, or deceptive information.
• 6. Member Accounts.

  You must register an account to access and use many features of the ShareYaSpace Platform. Registration is only permitted for persons who are 18 years or older. You must provide accurate, current, and complete information during registration and keep your account information up-to-date.

  You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify ShareYaSpace if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised.

  Note: At ShareYaSpace, we want to build the world's most trusted community. To help ensure our member's safety, we dedicate a knowledgeable and experienced team to monitor any suspicious activity in our marketplace.

• 7. Indemnification.

  To the maximum extent permitted by applicable law, you agree to release, defend (at ShareYaSpace’s option), indemnify, and hold ShareYaSpace (including ShareYaSpace Payments, other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your breach of these Terms
  • Your improper use of the ShareYaSpace Platform
  • Your interaction with any Member, stay at a Space, or
  • Your breach of any laws, regulations or third-party rights such as intellectual property or privacy rights.

  You agree to release, defend, indemnify, and hold ShareYaSpace harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with the ShareYaSpace Terms.

• 8. Miscellaneous.

  • 8.1 Force Majeure: ShareYaSpace shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

    ShareYaSpace shall in no event be liable especially for: - The consequences of virtual or real meetings between Users following use of the Platform; - For any damage resulting from any wrongdoing caused by the User, or any events attributed to a third party unconnected, or in the event of an act of God.

  • 8.2 Compliance With Applicable Law(S), Regulations And Agreements With Third Parties

    Any Host represents and warrants that any rentable Space, and the booking of, or a Guest’s stay at a Space the Host creates will not breach any agreement you have entered into with any third parties, lease, or rental agreements.

  • 8.3 Insurance: We encourage Host to ensure that their property and any related liability is adequately insured for this purpose.

  • 8.4 Emails and SMS: You will receive administrative communications from us using the email address or other contact information you provide for your ShareYaSpace account.

  • 8.5 Notices: Unless specified otherwise, any notices or other communications to Members permitted or required under this Agreement, will be in writing and given by ShareYaSpace via email, ShareYaSpace Platform notification, or messaging service (including SMS).

Nondiscrimination Policy

ShareYaSpace Members (Hosts and Guests) agree to act in accordance with the following policy to strengthen our community and realize our mission of ensuring that everyone can belong and feels welcome sharing space anywhere in the world, and in all of their interactions using the ShareYaSpace platform.

• Inclusion – We welcome people of all backgrounds with authentic hospitality and open minds. Joining ShareYaSpace, as a Host or Guest, means becoming part of a community of inclusion.
• Respect – We are respectful of each other in our interactions and encounters.

ShareYaSpace Referral Program Terms and Conditions

The ShareYaSpace Referral Program allows Members to earn promotional coupon credits toward future bookings by referring friends to become new users on ShareYaSpace.

If you are invited to the ShareYaSpace Platform, the person who invited you can submit personal information about you such as your email address or other contact information.

Members can earn Credits if: (i) a referred friend clicks on their referral link to create a valid ShareYaSpace account; and (ii) the referred friend completes a Qualifying Reservation.

Updates to the Terms

ShareYaSpace reserve the right to edit, update or remove any information added to its platform. We can update these terms at any time without prior notice. * Terms of service last updated on March 2021.
